Please consider carefully before completing a registration form if you are ready to attend and pay for an event. Payment for either the SEAL Adventure Challenge or the Special Operations Forces Academy requires a great deal of resources to sponsor. Registration forms received without payment will not reserve a space in the requested events and are not processed. Be sure to complete the payment phase of the registration.

Waiver of Liability		SEAL Training Adventures LIABILITY WAIVER 1. AS A PARTICIPANT I UNDERSTAND AND ACKNOWLEDGE THAT: A. Participation in events produced by SEAL Training Adventures entails known and unanticipated risks which could result in physical or emotional injury, damages or illness including, but not limited to, bodily injury, disease, strains, fractures, partial and/or total paralysis, death or other ailments that could cause serious disability to myself, to property or to third parties. I acknowledge that such risk cannot be eliminated without jeopardizing the essential qualities of the activity. B. SEAL Training Adventures takes reasonable precautions to insure that challenges and activities at Fort Story, or any and all other activities led, run, or organized by SEAL Training Adventures are conducted by qualified personnel in a safe and responsible manner. However, I further understand that these activities involve certain risks, both physical and emotional. I acknowledge and assume the risk of injury and/or disability inherent with being an active participant in SEAL Training Adventures events produced by SEAL Training Adventures. C. If applicable, I have disclosed all medical conditions and all physical activity concerns on the attached “MEDICAL/PHYSICAL CONCERNS QUESTIONAIRE”. D. SEAL Training Adventures events are physically demanding and the potential for injury to myself exists even though safety systems are provided. I agree to assume, and bear the costs of all risks that may be created, directly or indirectly, by any medical condition that I may have. E. All of the activities are strictly voluntary, and it is always the responsibility of the participant to limit his or her participation in any way he or she deems appropriate. F. Failure to follow safety instructions may lead to a participant’s removal from the events. Discretion is left entirely to SEAL Training Adventures directors and staff to determine whether and when removal is appropriate. G. Participants may be transported by SEAL Training Adventures contracted vehicles to and from activities at various sites. H. SEAL Training Adventures event staff or contractors may photograph and/or film me. You will not be notified if your photograph or likeness is to be published and/or used for profit. 2. AS A PARTICIPANT, I AGREE: A. To hold harmless SEAL Training Adventures and their officers, employees, and agents from any claim, damage, liability, injury, expense or loss, including defense costs and attorney’s fees, arising from activities under this agreement. B. To authorize SEAL Training Adventures to initiate emergency evacuation or treatment in case of serious injury or illness. I acknowledge that I have read and fully understand this document. 1. Authority to Register and/or to Act as Agent. You represent and warrant to SEAL Training Adventures that you have full legal authority to complete this event registration including full authority to make use of the credit or debit card to which registration fees will be charged. In addition, if you are registering third parties, you represent and warrant that you have been duly authorized to act as agent on behalf of such parties in performing this event registration. By proceeding with this event registration, you agree that the terms of this Registration Agreement shall apply equally to you and to any third parties for whom you are acting as agent. Compliance with Children's Online Privacy Protection Act (COPPA). You represent and warrant that, in compliance with COPPA, you are over thirteen (13) years of age, and that if you are registering a child under fourteen (14) years of age you are the parent of such child, and do hereby consent to the collection of such child's personal information by Active. 2. Limitation of Liability; Disclaimer of Warranties. SEAL Training Adventures SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, RESULTING FROM (A) THE USE OR THE INABILITY TO USE sealtrainingadventures.com OR (B) FOR THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES OR (C) RESULTING FROM ANY GOODS OR SERVICES PURCHASED OR OBTAINED OR TRANSACTIONS ENTERED INTO THROUGH ACTIVE OR (D) RESULTING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, USE, DATA OR OTHER INTANGIBLE, EVEN IF ACTIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOU EXPRESSLY AGREE THAT USE OF sealtrainingadventures.com IS AT YOUR SOLE RISK. ACTIVE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. ACTIVE EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. sealtrainingadventures.com makes no warranty that the sealtrainingadventures.com sites' services will be uninterrupted, secure or error free. Active does not guarantee the accuracy or completeness of any information in, or provided in connection with, the sealtrainingadventures.com site. sealtrainingadventures.com is not responsible for any errors or omissions, or for the results obtained from the use of such information. You understand and agree that any material and/or data downloaded or otherwise obtained through the use of the sealtrainingadventures.com site is at your own discretion and risk and that you will be solely responsible for any damage to your own computer system or loss of data that results from the download of such material and/or data. 3. Indemnification. You agree to indemnify and hold each of SEAL Training Adventures and its officers and employees harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of sealtrainingadventures.com or the violation of any term of this Liability Waiver. or the Active Terms of Service by you. 4. Applicable Law; Consent to Jurisdiction. The sealtrainingadventures.com site (excluding linked sites) are controlled by SEAL Training Adventures from its offices within the State of Maryland, United States of America. By completing this event registration, both you and SEAL Training Adventures agree that the statutes and laws of the State of Maryland, without regard to the conflict of laws principles thereof, will apply to all matters relating to this event registration, this Liability Waiver, or other use of the sealtrainingadventures.com site. You agree that exclusive jurisdiction for any dispute with SEAL Training Adventures resides in the courts of the State of Maryland and you further agree and expressly consent to the exercise of personal jurisdiction in the courts of the State of Maryland in connection with any dispute including any claim involving SEAL Training Adventures or its affiliates, subsidiaries, employees, contractors, officers, directors, telecommunication providers and content providers. 5. Severability. If any provision of this Liability Waiver shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this Liability Waiver and shall not affect the validity and enforceability of any remaining provisions. 6. SEAL Training Adventures shall only use any Personal Identifying Information (as defined below) for the purpose of order processing, fulfillment, customer service, and renewal purposes. SEAL Training Adventures shall not use any Personal Identifying Information for marketing or solicitation purposes or for any other purpose not explicitly permitted in this Agreement. "Personal Identifying Information" shall include any information about users of SEAL Training Adventure's website.
